Dri Ink Publishing BYPWin4 Software License Agreement

DEFINITIONS
The term "Software" as used in this agreement means the computer programs, and components contained in the software package, together with any updates subsequently supplied by Dri Ink Publishing.
The term "Related Materials" means all of the published materials provided in this package or later supplied by Dri Ink Publishing.

Network System Software
You may use the Client Module Software on any number of computers or workstations at one location.
You may use the Server Module Software on a single computer or workstation.

You may (a) make one copy of the Software for back-up or archival purposes only, or (b) transfer the Software to a single hard disk drive provided you keep the original files for back-up or archival purposes only. This license gives you certain limited rights to use the Software and Related Materials. You do not become the owner of and Dri Ink Publishing retains title to all the Software and Related Materials.
In addition, you agree to use reasonable efforts and take all responsible steps to protect the Software and Related Materials from unauthorized use, reproduction, distribution, or publication.

USES NOT PERMITTED
You may not make copies of the Software, except as permitted above.
You may not make copies of the Related Materials.
You may not share, transfer, sub-license, rent, or lease the Software, Related Materials or your rights to any person or firm without the prior written consent of Dri Ink Publishing.
You may not alter, decompile, disassemble, or reverse-engineer the Software, or make any attempt to alter or bypass the proprietary software identification system.

TERM
This license agreement is effective from the day you receive the software package. Your license continues for fifty years or until you return to Dri Ink Publishing the Software and Related Materials and any back-up copies, whichever comes first.

LIMITED WARRANTY
Dri Ink Publishing warrants that the Software will conform, as to all substantial operational features, to Dri Ink Publishing's current published specifications, documentation and authorized advertising; that,
the Related Materials accompanying the Software contains the necessary information to utilize the Software; and that,
the media on which the Software is furnished shall be free from defects in materials and workmanship for a period of 90 days from the date of delivery to you as evidenced by a copy of your sales receipt.
EXCEPT FOR THE LIMITED WARRANTY SET FORTH ABOVE, DRI INK PUBLISHING MAKES NO OTHER WARRANTIES EXPRESS OR IMPLIED, WITH RESPECT TO THE SOFTWARE AND
SPECIFICALLY DISCLAIMS THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

LIABILITY
In no event shall Dri Ink Publishing be responsible for any indirect, special, or consequential damages or lost profits, even if we have been advised of the possibility of such damage.
Dri Ink Publishing's liability for any damages or loss to you or any other party shall not exceed the license fee paid, regardless of the form of the claim.
This agreement may not be modified without written consent by Dri Ink Publishing. This license agreement shall be governed by and interpreted in accordance with the laws of the state of Illinois.
If any provision of this agreement in any way contravenes the laws of the state or jurisdiction in which this license agreement is to be performed, such provision shall be deemed to be deleted and,
if any term of this license agreement shall be declared by final adjudication to be illegal or contrary to public policy, it shall not affect the validity of any other term or provision of this license agreement. If any action is brought by either party to this license agreement against the other party regarding the subject matter of this license agreement, the prevailing party shall be entitled to recover,
in addition to any other relief, reasonable attorney's fees and expenses. If you breach this agreement, we can terminate this license upon notifying you in writing.
You will be required to return all Software and Related Materials. We can also enforce our other legal rights.
EXCEPT AS EXPRESSLY PROVIDED FOR USE IN THIS LICENSE, YOU MAY NOT USE, COPY, MODIFY, REPRODUCE, TRANSFER, SHARE OR DISTRIBUTE THE SOFTWARE IN WHOLE OR IN PART,
WITHOUT FIRST OBTAINING DRI INK PUBLISHING'S WRITTEN PERMISSION.
